class=\"fonts-plugin-block \" style=\"font-size: 17px;line-height: 1.4\">In his thesis entitled <em>Les droits et libert\u00e9s fondamentaux du salari\u00e9 au travers du prisme de la relation d&#8217;emploi<\/em> (The Fundamental Rights and Freedoms of the Employee Through the Prism of the Employment Relationship), S\u00e9bastien Parent seeks to understand the influence of norms specific to labour law in the interpretation of the fundamental rights of the employee.\u00a0<br>\u00a0<br>The theory of fundamental rights and the phenomenon of constitutionalization of labour law heralded the advent of citizenship at work: as a holder of fundamental rights against state powers in society, it seemed normal that the employee could also oppose them to employers\u2019 powers. These guarantees are inherent to all human beings, universal and inalienable. Under the hierarchical effect of the Quebec Charter, rights and freedoms have been introduced into the employment relationship. However, because they are stated in general and abstract terms, their concrete implementation in the workplace requires the intervention of the courts.\u00a0<br>\u00a0<br>Based on a study of the decisions that have interpreted freedom of expression and the right to privacy over the past decade, the candidate&#8217;s work demonstrates that labour judges exploit the indeterminate nature of rights and freedoms in order to modulate them to the prescriptions of labour law norms, including those stemming from labour legislation, contract of employment, collective agreement and workplace rules. These traditional sources of labour law therefore condition the exercise of employees&#8217; freedoms in the workplace and allow employers to impose a number of restrictions on them. However, the hierarchy of sources of labour law requires that priority be given to the quasi-constitutional guarantees of the Quebec Charter over the ordinary norms in labour law.\u00a0<br>\u00a0<br>The thesis then discusses the important consequences of this reversal of the pyramid of norms, both in terms of the coherence of the legal system and the protection of workers. It also proposes solutions so that the status of employee and human person can finally be reconciled.\u00a0<br>\u00a0<br>S\u00e9bastien Parent is currently completing the doctoral program at the Faculty of Law of the Universit\u00e9 de Montr\u00e9al. He holds a bachelor&#8217;s and master&#8217;s degree in law as well as a bachelor&#8217;s degree in industrial relations from the same university. The relevance of his research project has been recognized by the awarding of various doctoral grants (FRQSC, Faculty of Law (UdeM), CRIMT and the F\u00e9d\u00e9ration autonome de l&#8217;enseignement (FAE)).\u00a0During his PhD, he completed a research stay at the Centre de droit compar\u00e9 du travail et de la s\u00e9curit\u00e9 sociale (COMPTRASEC), at the Universit\u00e9 de Bordeaux. His various publications and media interventions over the past few years demonstrate his concern for establishing a dialogue with both academic circles and actors in the world of work. The International Labour Organisation (ILO) considers work in the fishing industry to be one of the most dangerous. On board fishing vessels, workers face multiple hazards and particularly harsh working conditions, mainly due to weather conditions, and a slippery and constantly moving working environment.<br><br>On a global scale, abuses of workers&#8217; rights on board ships are extremely difficult to document as they take place far from the coast, out of sight, with no possibility for workers to escape or to seek justice.<br><br>This thesis project examines the impacts of globalisation and the reconfiguration of supply chains in the fisheries sector on West African workers&#8217; rights.<br><br>It has two objectives. Firstly, it aims to analyse the application of international labour law, and particularly the ILO Work in Fishing Convention (No. 188), in the West African region. Secondly, through a field survey in Senegal, the aim is to document how workers in the fisheries sector use the protections offered by labour law.<br><br>By focusing on the experiences of aggrieved workers and their use of the regulations intended for them, this research project will make it possible to measure the effects of international labour standards on the working conditions of West African fishermen, but also to understand the relationship that these fishermen have with the legal resources available to them.<br>The results of this study will help to identify ways to improve working conditions in the fisheries sector, not only for the West African region but also for the maritime industry in general, which faces similar challenges.<br>\u00a0<br>Majda Lamkhioued is currently a doctoral candidate in the Law Faculty at Universit\u00e9 de Montr\u00e9al. She holds a bachelor&#8217;s degree in political science from ESPOL in France and a master&#8217;s degree in international law from the Universit\u00e9 de Montr\u00e9al. She has several professional experiences in NGOs and international organisations, including the Labour Migration and Human Development Division at the International Organisation for Migration (IOM) in Geneva. She has also carried out various mandates as a research assistant for various actors involved in the defence and promotion of workers&#8217; rights. Il travaille sous la direction des professeurs Michel Coutu (Universit\u00e9 de Montr\u00e9al) et Julie Bourgault (Universit\u00e9 du Qu\u00e9bec en Outaouais).<br>\u00a0<br>En fonction de changements dans la jurisprudence de la Cour supr\u00eame du Canada en mati\u00e8re de libert\u00e9 d\u2019association, en particulier l\u2019arr\u00eat\u00a0<em>Saskatchewan Federation of Labour<\/em>\u00a0c.\u00a0<em>Saskatchewan<\/em>\u00a0de 2015 qui a accord\u00e9 une protection constitutionnelle \u00e0 l\u2019exercice de la gr\u00e8ve par des salari\u00e9s, cette th\u00e8se s\u2019int\u00e9resse au statut des gr\u00e8ves qualifi\u00e9es atypiques. Celles-ci sont atypiques en raison de leurs revendications (par exemple, la gr\u00e8ve de nature politique ou la gr\u00e8ve en solidarit\u00e9 d\u2019un autre groupe de travailleurs) ou en raison de leurs moyens entrepris (par exemple, le ralentissement de la production au travail ou la gr\u00e8ve lors de la dur\u00e9e active d\u2019une convention collective). Cette th\u00e8se s\u2019int\u00e9resse \u00e0 la question des gr\u00e8ves atypiques \u00e9galement en raison d\u2019une conception plus large du droit de gr\u00e8ve promulgu\u00e9 par le droit international, notamment le Comit\u00e9 de la libert\u00e9 syndicale du Bureau international du travail, affili\u00e9 \u00e0 l\u2019Organisation internationale du travail, mais \u00e9galement en raison d\u2019observations r\u00e9centes\u00a0: les salari\u00e9s, malgr\u00e9 les interdictions concernant plusieurs formes de gr\u00e8ves atypiques ont parfois recours \u00e0 celles-ci, comme l\u2019illustre les cas m\u00e9diatis\u00e9s de \u00ab\u2009sit-in\u2009\u00bb effectu\u00e9s par du personnel infirmier qu\u00e9b\u00e9cois.<br>\u00a0<br>Cette th\u00e8se cherche \u00e0 r\u00e9pondre aux questions suivantes, une question de recherche globale et deux autres questions de recherche connexes. D\u2019abord, de fa\u00e7on globale, les gr\u00e8ves atypiques sont-elles des composantes indispensables de la n\u00e9gociation collective et devraient-elles ainsi \u00eatre prot\u00e9g\u00e9es par la\u00a0<em>Charte canadienne des droits et libert\u00e9s<\/em>\u2009? Ensuite, de fa\u00e7on connexe, remarque-t-on une tendance des salari\u00e9s canadiens \u00e0 inscrire leur recours \u00e0 la gr\u00e8ve dans des revendications d\u00e9passant le cadre strict de la relation d\u2019emploi (des revendications politiques, sociales ou environnementales) et quels facteurs expliquent le recours par un groupe de salari\u00e9s canadiens \u00e0 une forme de gr\u00e8ve atypique\u2009?<br>\u00a0<br>Pour r\u00e9pondre \u00e0 ces questions, cette th\u00e8se se basera sur les travaux des sociologues Max Weber et Guy Rocher qui concerne la l\u00e9gitimit\u00e9 du droit (des travaux postulant que la conduite des individus ou groupes peut converger ou diverger des normes juridiques \u00e9tatiques) et des travaux de juristes am\u00e9ricains critiques du mod\u00e8le de relations de travail nord-am\u00e9ricain provenant du\u00a0<em>National Labor Relations Act<\/em>\u00a0ou \u00ab\u2009Loi Wagner\u2009\u00bb. La r\u00e9alisation d\u2019une revue historique de l\u2019exercice de la gr\u00e8ve au Canada (d\u2019un point de vue social et juridique) est propos\u00e9e afin de d\u00e9terminer la place qu\u2019ont occup\u00e9e les gr\u00e8ves atypiques et l\u2019origine de la distinction entre gr\u00e8ve typique et gr\u00e8ve atypique. Par la suite, il sera effectu\u00e9 une analyse de la l\u00e9gislation, de la jurisprudence et de la doctrine canadienne et d\u2019autres l\u00e9gislations pertinentes relativement aux gr\u00e8ves, en tenant compte des cas o\u00f9 les salari\u00e9s ont \u00e9t\u00e9 sanctionn\u00e9s pour fait de gr\u00e8ve atypique, brossant ainsi le portrait juridique de ce ph\u00e9nom\u00e8ne. Enfin, des acteurs du monde syndical qu\u00e9b\u00e9cois seront interrog\u00e9s, dans le but de comprendre les implications dans les dynamiques syndicales de la question des gr\u00e8ves atypiques.<br>\u00a0<br>Alexandre Jett\u00e9 est pr\u00e9sentement candidat au doctorat \u00e0 la Facult\u00e9 de droit de l\u2019Universit\u00e9 de Montr\u00e9al. Il est titulaire d\u2019un baccalaur\u00e9at et d\u2019une ma\u00eetrise en relations industrielles effectu\u00e9es \u00e0 l\u2019Universit\u00e9 de Montr\u00e9al. Fort de cette double appartenance disciplinaire, ses champs d\u2019int\u00e9r\u00eat se situent au niveau du droit constitutionnel du travail, des rapports collectifs de travail et des transformations qui concernent le droit du travail en lien avec la mondialisation, l\u2019arriv\u00e9e de nouvelles technologies et les changements au sein des valeurs et des identit\u00e9s collectives. Il participe ainsi \u00e0 divers projets s\u2019inscrivant dans le cadre de la recherche men\u00e9e par les professeurs Michel Coutu (Universit\u00e9 de Montr\u00e9al) et Ruth Dukes (Universit\u00e9 de Glasgow), financ\u00e9s par le CRSH, sur la\u00a0<em>nouvelle constitution du travail<\/em>. Cette connexion constante au milieu professionnel peut \u00eatre expliqu\u00e9e par plusieurs facteurs, dont les attentes du milieu professionnel et la surcharge de travail. Elle est associ\u00e9e, selon de nombreuses \u00e9tudes et m\u00e9ta-analyses, \u00e0 plusieurs effets n\u00e9fastes sur la sant\u00e9, sur l\u2019\u00e9quilibre travail-vie personnelle ainsi que sur les trajectoires professionnelles des personnes salari\u00e9es\u00a0: il s\u2019agirait donc non seulement d\u2019une question de normes du travail, mais \u00e9galement de sant\u00e9 et s\u00e9curit\u00e9 au travail. La th\u00e8se de Genevi\u00e8ve Richard vise plus pr\u00e9cis\u00e9ment \u00e0 d\u00e9terminer si et comment, dans ce contexte, les personnes salari\u00e9es peuvent mobiliser la l\u00e9gislation qu\u00e9b\u00e9coise pour prot\u00e9ger la fronti\u00e8re entre leur temps de travail et leur temps de repos.<br><br>En vue de r\u00e9pondre \u00e0 sa question de recherche, elle a \u00e9tudi\u00e9 les dispositions de diff\u00e9rentes lois (<em>Loi sur les normes du travail<\/em>,\u00a0<em>Loi sur la sant\u00e9 et la s\u00e9curit\u00e9 du travail<\/em>,\u00a0<em>Charte des droits et libert\u00e9s de la personne<\/em>) ainsi que les d\u00e9cisions jurisprudentielles en la mati\u00e8re. Elle a de plus r\u00e9pertori\u00e9 des dispositions l\u00e9gislatives adopt\u00e9es ou \u00e9tudi\u00e9es dans d\u2019autres \u00c9tats visant \u00e0 prot\u00e9ger le temps de repos des personnes salari\u00e9es, en leur permettant notamment d\u2019\u00eatre injoignables durant cette p\u00e9riode. Afin de mieux comprendre l\u2019impact de ces dispositions, elle a \u00e9tudi\u00e9 des \u00e9crits t\u00e9moignant de leur mise en \u0153uvre et leurs effets. \u00c9galement, elle a men\u00e9 des entretiens aupr\u00e8s de 20 intervenant\u00b7es de milieux syndiqu\u00e9s qu\u00e9b\u00e9cois afin de mieux comprendre comment les enjeux de disponibilit\u00e9 hors des heures de travail, de (non\u2011)d\u00e9connexion, de surcharge de travail et de temps suppl\u00e9mentaires \u00e9taient v\u00e9cus au sein de ces organisations.<br><br>Son analyse s\u2019appuie sur les notions d\u2019effectivit\u00e9 du droit (c\u2019est-\u00e0-dire l\u2019\u00e9tude de l\u2019ensemble des effets produits par une norme) et de non-mobilisation du droit (en d\u2019autres mots, les facteurs expliquant pourquoi des personnes cr\u00e9anci\u00e8res de droit ne les exerceraient pas). Elle mobilise \u00e9galement le pouvoir qu\u2019ont, le cas \u00e9ch\u00e9ant, les diff\u00e9rentes parties au contrat de travail ou \u00e0 la convention collective.<br>Les r\u00e9sultats de sa recherche documentaire et de ses entretiens semi-dirig\u00e9s lui ont permis de se positionner en faveur d\u2019une intervention l\u00e9gislative visant \u00e0 limiter les intrusions du travail dans le temps hors travail des personnes salari\u00e9es, sous la forme d\u2019un droit \u00e0 la d\u00e9connexion. \u00c0 cette fin, elle formule plusieurs recommandations de modification aux lois qu\u00e9b\u00e9coises en vigueur afin de prot\u00e9ger le temps de repos des personnes salari\u00e9es, leur sant\u00e9 ainsi que la fronti\u00e8re entre le travail et leur vie priv\u00e9e.<br><br>Genevi\u00e8ve Richard est membre du Barreau du Qu\u00e9bec et d\u00e9tient une ma\u00eetrise (2019) ainsi qu\u2019un baccalaur\u00e9at (2008) en droit de l\u2019Universit\u00e9 de Montr\u00e9al. Apr\u00e8s avoir compl\u00e9t\u00e9 son stage au bureau de Gen\u00e8ve de l\u2019Organisation internationale du Travail (OIT 2009-2010), elle a travaill\u00e9 comme avocate d\u2019un service d\u2019information juridique, de m\u00eame que comme \u00e9ditrice chez un \u00e9diteur juridique. Ses travaux de recherche au doctorat ont \u00e9t\u00e9 r\u00e9compens\u00e9s par des bourses octroy\u00e9es par le CRIMT, la F\u00e9d\u00e9ration autonome de l\u2019enseignement (FAE), la Fondation J.-A.-de-S\u00e8ve, le FRQSC et\u00a0<a>l\u2019\u00e9quipe de recherche interdisciplinaire sur le travail Sant\u00e9-Genre-\u00c9galit\u00e9 (SAGE)<\/a>.
